Keweenaw County ZBA to hold public hearing Feb. 26 on commercial septic zoning

EAGLE RIVER -- The Keweenaw County Zoning Board of Appeals (ZBA) will hold a public hearing at 6:30 p.m. on Tues., Feb. 26 in the Courthouse in Eagle River to consider Zoning Ordinance interpretations. The ZBA is expected to report on a response from the County Prosecuting Attorney, Donna Jaaskelainen, concerning whether septic systems utilized by a commercial enterprise cross over into a residential zone. South Shore (Lac La Belle) residents raised the issue because the Mt. Bohemia septic system extends into a Resort Residential zoning district.

A Feb. 13, 2002, email communication from Richard Powers, Grant Township trustee, to Jane Pelto, zoning administrator, will be considered at the hearing. Citing Section 11.4 of the County Zoning Ordinance, Powers says he has been unable to find anything relating to septic fields in the Ordinance.

"It is my opinion that the ZBA would be exceeding their authority if they made any decisions in this case," Powers writes. "If this is a valid concern it should be referred to the County as a possible ordinance change."

South Shore Association President Tom Collins had asked the ZBA to consider the zoning of Mount Bohemia septic system, since it crosses over into Resort Residential Zoning. At their January meeting, the ZBA said they would not rule on the issue until consulting with the County Prosecuting Attorney, Donna Jaaskelainen.

A letter from Richard and Bonnie Harrer concerning the Hebard Park survey of property lines is also on the ZBA agenda. Their letter will also be considered by the  Keweenaw County Zoning /Planning Commission, which will meet at 7 p.m. following the ZBA public hearing.

Other correspondence for the Zoning/Planning Commission includes a Progress Report on Land Use Study from the Eagle Harbor Township Board.
